CHENNAI: Declining to set aside a notification issued by the state government mandating approval from state level heritage screening committee to carry out renovations in temples, the Madras high court has made it clear that only the committee can decide whether a temple is of heritage value or not.
“It is very clear that temples not more than 100 years old will not fall under the purview of notification. But the issue as to whether the temple is ancient, or is of heritage value or not, has to be decided only by the committee and not by anyone else. Only the committee will examine the archaeological and architectural value/ ancientness of the temple and arrive at a conclusion, as to whether permission is required or not,” a division bench of Justice S Manikumar and Justice Subramonium Prasad said.

The bench made the observation while disposing of a plea moved by Trichy-based Sendalankara Jeer Trust to quash a notification dated February 14, 2017, in so far as its application to non-heritage and non-ancient temples under the administrative control of the HR&CE department.

According to the petitioner, it prohibits all renovation and repair work in temples in Tamil Nadu without obtaining prior approval from the government. “Though the notification is only for ancient and heritage temples, it actually states that no repair or renovation should be carried out in any temple without obtaining prior approval of the heritage committee. But temples which are not ancient, and heritage should not require the approval of the heritage committee,” he contended.

10,000 Major Artworks, Stolen From India Every Decade, Claims Expert

    Some stolen pieces are replicated without people realising it.
    The US is the biggest market for these stolen pieces, followed by the UK and now it is moving to Australia

An estimated 1,000 pieces of ancient artworks are stolen from Indian temples every year and shipped to the international market, according to Singapore-based Indian-origin shipping executive.

    "We are estimating about close to 10,000 major work of arts leaving India every decade," said S Vijay Kumar, who has been tracking the theft of venerable gods and goddess for 15 years. Some of these are as heavy as 15-16 tonnes.

Kumar has detailed the artwork theft in a book "The Idol Thief", which was launched in Singapore on Saturday.

"We have tracked some of the huge objects 15-16 tonnes sculptures, that have left the country by Ocean containers, declared as brassware and garden furniture," Kumar told PTI.

"Sadly, for a long time it has not been cared for," he said, pointing out that not many people realise the extent of the loot which is a targeted loot on an industry scale. Some stolen pieces are replicated without people realising it.

Industry scale loot means auction houses are sending their top executives to pick and choose art pieces while some are sharing the pictures on social media what can be sourced out of the Indian heritage, he explained. On selecting a specific artwork, the illegal process of acquiring it starts.

Kumar has legally checked and compiled his adventure of tracking looted Indian idols and artworks in the 225-page book of true events.

To escape tracking, routes for container shipment of huge sculptures are changed from Chennai, Mumbai, Kolkata and Hong Kong on to New York and London as well as other international destinations. Smaller pieces are being couriered, he said.

The US is the biggest market for these stolen pieces, followed by the UK and now it is moving to Australia, according to Kumar.

Tracking these stolen pieces is difficult in the border-less European Union where some countries like Germany are putting in tougher laws on protecting antiquity works.

Kumar has an 11-member team of volunteers and supported by some 200 spread across the globe, all working for free.

The chartered accountant from Tamil Nadu opens the book with a story on Subhash Kapoor, who is in Chennai jail for theft of idols from Indian Temples.

    American authorities have recovered stolen Indian art worth USD 100 million from arrested Kapoor's warehouses and galleries and named him "one of the most prolific commodities smugglers in the world".

Kumar said India needs a powerful law to protect its artwork.

Almost all stolen Indian artworks in the international market are without documents. There is no archive on most of the Indian artwork, regrets Kumar who has played a role in the arrest of many idol thieves and smugglers.

Among the prized stolen artwork are pieces from the Chola dynasty which witnessed the building of many elaborately carved stone temples all over Tamil Nadu from 850 CE to 1250 CE.

Giving a comparison, he said Italy was the front-runner in protecting its artwork with tough laws which has helped recover 378,000 pieces 2012 while India has rescued 27 pieces since 2012.

Worldwide thinking is changing with the onus being put on a buyer to prove that the genuine artwork is acquired legally.

Egypt, for one, is recovering stolen artwork by just pointing out the Egyptian origin, putting pressure on a buyer to proof it is a legal acquisition.

கலசங்களை அபிஷேகம் செய்யும் நீரை பக்தர்கள் மீது தெளித்துவிட்டு, கணக்குவழக்குகளில் கண்கட்டு வித்தை காட்டுகிறது அறநிலையத்துறை.

இந்தக் குழுவில் யுனெஸ்கோ இந்தியப் பிரிவின் அதிகாரிகளான ஷிகா ஜெயின், தெபாசிஷ்நாயக், அபூர்வா சின்கா, மத்திய தொல்லி யல் துறை அதிகாரி பகவான் சரத் இவர்களோடு திருவரங்கம் ரங்கராஜன் நரசிம்மனும் இருந்தார். இந்த ரங்கராஜன் நரசிம்மன் 2015 மார்ச்சில் சென்னை உயர்நீதிமன்றத்தில், ‘இந்து சமய அறநிலையத் துறையினர் தங்கள் கட்டுப்பாட்டில் உள்ள தொன்மையான கோயில்களில் கோயில் ஆகமங் களையோ, மரபு களையோ, தங்கள் சட்ட விதிகளையோ பின்பற்றுவ தில்லை.

புனரமைப்பு, குடமுழுக்கு என்ற பெயரில் கோயில்களைத் தோண்டுகிறார்கள். சுவர்களை உடைக் கிறார்கள். கல்வெட்டுகளை பாழ்படுத்துகிறார்கள்’ என்று மனு தாக்கல் செய்தார்.

ஏற்கெனவே இதுபோன்ற ஒரு வழக்கு, பொதுநல வழக்காக இருந்ததால் அதோடு திருவரங்கம் ரங்கராஜன் நரசிம்மன் மனுவையும் இணைத்துக்கொண்டது உயர்நீதி மன்றம்.

இதையடுத்து "தொன்மையான கோயில்களை அதன் பாரம்பரியத்தோடு பாதுகாக்க வேண்டியது அரசின் கடமை. ஆகவே, தமிழக கோயில்களில் திருப்பணிகளோ, குட முழுக்கோ செய்யக்கூடாது" என இடைக்காலத் தடை விதித்தது உயர்நீதிமன்றம்.

உயர்நீதிமன்றத்தின் இடைக்காலத் தடையை மீறி தனது கட்டுப்பாட்டிலுள்ள பல கோயில் களில் குடமுழுக்கு களையும் திருப்பணிகள் என்ற பெயரில் மராமத்து வேலை களையும் செய்தது அறநிலையத்துறை.

இதையடுத்து நீதிமன்ற அவமதிப்பு வழக்கை தாக்கல் செய்தார் ரங்கராஜன் நரசிம்மன்.

இதனை விசாரித்த நீதிபதிகள், ஐ.நா.வின் யுனெஸ்கோ இந்தியப் பிரிவிடம் "கோயில் பராமரிப்பு என்ற பெயரில் அற நிலையத்துறை தவறுகளைச் செய்திருக்கிறது? அவற்றை எப்படிச் சரிசெய்வது? தொன்மையான என் னென்ன கோயில்களை எப்படிப் பராமரிக்கவேண்டும் என்று யோசனை கேட்டார்கள். -

"ஆய்வு செய்தபிறகுதான் தெரிவிக்க இயலும் என்றது யுனெஸ்கோ இந்தியப் பிரிவு.

இதைக்கண்டு அஞ்சிய அறநிலையத் துறை  "நீங்கள் ஆய்வுக்கு வரக்கூடாது. வந்தால் மத மோதல்கள் உண்டா கும். ஆகவே நாங்கள் ஆய்வுக்கு வர மாட்டோம்' என்று உயர் நீதிமன்றத்திற்கு கடிதம் எழுதுங்கள்" என்று யுனெஸ்கோ இந்தியப் பிரிவுக்கு மிரட்டல் கடிதம் எழுதி யது.

அறநிலையத்துறையின் இந்தக் கடிதம், உயர்நீதிமன்றத்தின் கவனத்துக்குச் சென்றது. கோபமான நீதிபதிகள், இக்கடிதம் பற்றி அறநிலையத்துறையிடம் விளக்கம் கேட்டார்கள். நீதிமன்றத்திற்கு வந்த அறநிலையத்துறை ஆணையர், அப்படியொரு கடிதம் எழுதியதற்காக மன்னிப்புக் கேட்டுக்கொண்டார்.

இதன்பிறகே, இந்திய தொல்லியல்துறை உதவியுடன் நாம் மேலே குறிப்பிட்ட பத்து கோயில் ஆய்வுகளை மேற் கொண்டிருக்கிறார்கள் யுனெஸ்கோ வல்லுநர்கள். இந்தக் குழுவோடு அத்தனை கோயில்களுக்கும் சென்ற திருவரங்கம் ரங்கராஜன் நரசிம்மனை சந்தித்தோம்.

‘ஆய்வுக் குழுவில் நானும் இருந்தேன். சென்றேன். எனக்குத் தெரிந்த வரையில் எந்தக் கோயிலிலும் இந்து சமய அறநிலைய சட்ட விதிகளையோ, அந்தந்த கோயில் களின் ஆகம விதிகளையோ பின்பற்றவே இல்லை.
தமிழக ஆட்சியில் இருந்தவர்கள் கடந்த 4 ஆண்டுகளில் எட்டா யிரம் கோயில்களில் குடமுழுக்குச் செய்திருக்கிறார்கள். பொதுமக்கள் நன்கொடையில் அல்லது அந்தந்தக் கோயில் நிதியில் இருந்தே குடமுழுக்குகள் செய்யப்பட்டிருக்கின் றன. அந்த எட்டாயிரம் கோயில்களில் குடமுழுக்குக்கான எந்தவித தணிக்கையும் இல்லை. கணக்கும் இல்லை,

நெல்லையப்பர் கோயில், கோயில், கோயில், ரங்கநாதர் கோயில்களில் அவரவர் நோக்கத்திற்கு இடித்திருக் கிறார்கள். தோண்டியிருக்கிறார்கள், மீனாட்சியம்மன் அண்ணாமலையார் மீனாட்சியம்மன் கோயில் பொற் றாமரைக் குளத்தருகே இருந்த மண்டபத்தைக் காண வில்லை. 1500 ஆண்டுகளுக்கு முன் சோழர்கள் கட்டிய குடந்தை வானம்பாடி நாகநாதன் கோயிலையே இடித்து விட்டுக் கட்டியிருக்கிறார்கள். ‘ஏன் இடித்தீர்கள்?’ என்று கேட்ட யுனெஸ்கோ குழுவிடம், ‘பழைமை மாறாமல் திரும்பக் கட்டுறதுக்காக இடித்தோம்’ என்றார்கள்.

அண்ணாமலையார் கோயிலுக்குள், நான்காவது பிரகாரத்தில் அதிகாரிகள் ரெஸ்ட் எடுப்பதற்காகவே புதிதாக காட்டேஜ் கட்டியிருக்கிறார்கள். ரங்கநாதர் கோயிலில் ஆயிரம்கால் மண்டபம் அருகே புதையல் எடுப்பதற்காக தோண்டி, ஐம்பொன்னால் ஆன, பழமையான நடராஜர் சிலையையும் பெருமாள் சிலையையும் எடுத்திருக்கிறார்கள்.

இந்த சிலைகள் பற்றி தொல்லியல் துறைக்குத்  தெரிவிக் கவில்லை. இப்படிக் கணக்கற்ற விஷயங்கள் இந்த ஆய்வில் கண்டறியப்பட்டன யுனெஸ்கோ வல்லுநர்களின் ஆய்வறிக்கை, நிச்சயமாக இந்து சமய அறநிலையத் துறைக்கு  பெரும் அதிர்ச்சியைத் தரும் என்பது மட்டும் நூறு மடங்கு உண்மை' என்றார் ரங்கராஜன் நரசிம்மன்.

"பழிவாங்கும் எண்ணமும் சர்வாதிகாரப் போக்கும் கொண்ட வீரசண்முகமணி போன்றவர்களை இந்து சமய அறநிலையத்துறைக்கு ஆணையராக நியமிப்பதால்தான் இத்தனை முறைகேடுகளும் விதிமீறல்களும் நடக்கின்றன என்கிறார்கள் அதே துறையில் பணியாற்றும் ஊழியர்கள். முறைகேடுகள் மட்டுமின்றி, அதிகாரிகளும் அமைச்சர் களும் தக்கார்களும் அடித்திருக்கும் ஊழல் கொள்ளையும் அந்த ஆய்வறிக்கையில் நிச்சயம் இருக்கும் என்று நம்புவோம்.

Over 1,000 temples set to get a facelift


Annadhanam scheme to be extended to 50 more shrines
As many as 1,006 temples have been selected for renovation and consecration in the next financial year, Finance Minister O. Panneerselvam announced in the Budget on Monday.
An identical number of temples were renovated and consecrated in 2011-12.
The Annadhanam scheme, a brainchild of Chief Minister Jayalalithaa, which is being implemented in 468 temples, will be extended to 50 more temples during 2012-13. The kitchens of temples where this scheme is implemented will be modernised to provide hygienic food to devotees.
Besides, he said, the Chief Minister had ordered that the duration of annadhanam at the Sri Ranganatha Swami Temple, Srirangam, and Dandayuthapani Swami Temple, Palani, would be virtually throughout the day — from 8 a.m. to 10 p.m.

Ongoing works
Referring to ongoing works, he said that the construction of a yatri niwas at Srirangam, estimated to cost Rs.25 crore, was in progress. A cable car would be provided at the Palani temple.
Special initiative
“As another special initiative, the Chief Minister has ordered the conduct of spiritual and moral classes on all Saturdays in important temples to make our children imbibe the high moral and ethical values enshrined in our ancient literature.” The children would be provided with snacks during such classes and awards be distributed to those who excel.
The Minister announced that the Special Revenue Units and Revenue Courts would be further strengthened for the speedy retrieval of temple property and settling disputes with regard to temple lands.
Tamil development
In addition to the number of awards already instituted, two more awards — Kapilar Award and U.Ve.Sa Award — would be given to eminent Tamils scholars and Tamil Thaai Award presented to Tamil organisations rendering yeoman service for the development of Tamil.
The renovation of the Kamarajar Mandapam at Kanyakumari and Kamarajar Ninaivu Illam in Chennai will be taken up next financial year.

Sixteen Temple Renovations Completed in Tamil Nadu



CHENNAI, INDIA, July 2, 2004: The Hindu Religious and Charitable Endowments (HR and CE) Minister, P.C. Ramasamy, today said kumbhabishekams for 16 temples would be performed as per a revised schedule, after completing the renovation work. Denying reports that kumbhabishekams for 83 temples had been postponed, he said in a statement here that fresh dates had been announced, giving adequate time for completing the ongoing renovation work, as announced by the HR and CE department earlier. Meanwhile, an official release said spiritual personalities and devotees had expressed the view that it would be ideal to conduct kumbhabishekams for temples under the purview of the HR and CE department after the completion of renovation work as per Agama rules. Though the schedule for kumbhabishekams at some temples was already announced, the department had made it clear that the ceremony would be performed as per the revised schedule, only after completing the task of desilting, cleaning and renovating temple tanks.

As per the revised schedule, the following 11 temples are allowed to perform kumbhabishekam on August 22: Ramalingaswamy temple (Shenbaganallur); Thondargal Nainar temple (Tirunelveli district); Santhiveerappan temple (Urayur); Veeraperumal Ayyanar Sastha temple (Pattapuliyur); Kailasanathar temple (Kanniyakudi); Annapoornambika Sametha Ardhanareeswarar temple (Periyapalayam); Anandeeswarar temple (Adanchur); Anandeeswarar temple (Udayakkudi); Varasakthi Vinayakar temple (Chennai-3); Iravatheeswarar temple (Darasuram); and Varasakthi Vinayakar temple (Chennai-18). Five other temples -- Karpagavinayakar temple (Pillayarpatti); Prasanna Venkatesaperumal temple (Gunaseelam); Kapaleeswarar temple (Mylapore); Marundeeswarar temple (Tiruvanmiyur); and Agatheeswarar temple (Panchatti) -- have been permitted to perform kumbhabishekams on March 17, 2005, the release said.
